Advice and second opinions

We are regularly asked by clients to state their legal position in a family-law related dispute.

An example is the question of whether it is better to launch legal proceedings in the Netherlands or abroad. People also sometimes want to know what their position would be in the event of a divorce, even before a decision to divorce has been taken.

We also advise foreign legal bodies that have to issue rulings in which Dutch law has to be applied.

Additionally, we regularly provide background advice to parties seeking to reach agreement through mediation. It is precisely because a mediator does not take decisions that it makes sense for a party to seek information about their legal position from their own legal advisor. This means that the mediation negotiations can be conducted on the basis of realistic starting points.

Second opinion

In cases that have not led to the desired result or for advice that people would like to have verified, we regularly give a second opinion. This is effectively legal advice, but issued as a result of an existing ruling or existing advice.

Family and inheritance law are sensitive subjects that often involve strong emotions. Matters that once seemed routine can take on a new significance as a result of all kinds of events, causing a breakdown in communications and thrusting the parties involved into far-reaching and invasive legal proceedings. SmeetsGijbels advises its clients on what route to take. We do so with empathy and support, adding our specialist legal knowledge as necessary.
